Reinstatement Remedies

1. Special Damages: Lost Income

You may claim for “special damages” or lost income where you have been directly or constructively terminated due to a human rights violation or reprisal.

You can also assert a termination as a reprisal against a complaint or threatened complaint, which is independent of a finding of a breach of the human rights code substantive violation. Some jurisdictions require an actual complaint be filed before a reprisal remedy is allowed, which is discussed below.
